The order is intended to protect the State of Texas sensitive and critical infrastructures from certain entities designated as foreign adversaries by the U.S. Department of Commerce: China (including Hong Kong), North Korea, Iran, Cuba, and Russia (\u201cDesignated Countries\u201d); and Venezuelan President Nicolas Maduro. Executive orders have the force of law and must be followed by the state\u2019s agencies and their employees (including Texas public institutions of higher education and their faculty and staff employees).<\/div><\/div><\/div><div class=\"fusion-panel panel-default fusion-toggle-no-divider\"><div class=\"panel-heading\"><h4 class=\"panel-title toggle\"><a aria-expanded=\"false\" aria-controls=\"7d26ebca44b4e4e89\" role=\"button\" data-toggle=\"collapse\" data-parent=\"#accordion-19091-1\" data-target=\"#7d26ebca44b4e4e89\" href=\"#7d26ebca44b4e4e89\"><span class=\"fusion-toggle-icon-wrapper\" aria-hidden=\"true\"><i class=\"fa-fusion-box\" aria-hidden=\"true\"><\/i><\/span><span class=\"fusion-toggle-heading\">Why did the U.S. Department of Commerce designate China (including Hong Kong), North Korea, Iran, Cuba, Russia and Venezuelan President Nicolas Maduro as \u201cforeign adversaries\u201d?<\/span><\/a><\/h4><\/div><div id=\"7d26ebca44b4e4e89\" class=\"panel-collapse collapse \"><div class=\"panel-body toggle-content fusion-clearfix\">The Commerce Department has determined that the designated countries and foreign leader \u201chave engaged in a long-term pattern of serious instances of conduct significantly adverse to the national security of the United States or security and safety\u201d of individuals in the U.S.<\/div><\/div><\/div><div class=\"fusion-panel panel-default fusion-toggle-no-divider\"><div class=\"panel-heading\"><h4 class=\"panel-title toggle\"><a aria-expanded=\"false\" aria-controls=\"5bcf4bbffb6e94351\" role=\"button\" data-toggle=\"collapse\" data-parent=\"#accordion-19091-1\" data-target=\"#5bcf4bbffb6e94351\" href=\"#5bcf4bbffb6e94351\"><span class=\"fusion-toggle-icon-wrapper\" aria-hidden=\"true\"><i class=\"fa-fusion-box\" aria-hidden=\"true\"><\/i><\/span><span class=\"fusion-toggle-heading\">What does Executive Order GA-48 consider \u201ccritical infrastructure\u201d?<\/span><\/a><\/h4><\/div><div id=\"5bcf4bbffb6e94351\" class=\"panel-collapse collapse \"><div class=\"panel-body toggle-content fusion-clearfix\">Critical infrastructure is defined as a communication infrastructure system, cybersecurity system, IT infrastructure, electric grid system, hazardous waste treatment system, or water treatment facility. <a href=\"https:\/\/statutes.capitol.texas.gov\/DocViewer.aspx?DocKey=BC%2fBC.117&amp;Phrases=%22critical+infrastructure%22&amp;HighlightType=1&amp;ExactPhrase=True&amp;QueryText=%22critical+infrastructure%22\">Texas Business &amp; Commerce Code, section 117.001(2)<\/a>.<\/p>\n<p>Communication infrastructure could include groupware, email, project management software, fax, phone, teleconferencing systems, and document management systems.<\/p>\n<p>In general terms an IT infrastructure could include:<\/p>\n<p>Hardware \u2013 servers, computers, network devices, storage systems, and peripheral devices<\/p>\n<p>Software \u2013 operating systems applications, databases, virtualization, and other software programs that enable various functionalities within the infrastructure.<\/p>\n<p>Networks \u2013 Networking components such as routers, switches, firewalls, and cables connect devices and facilitate data transmission across the infrastructure.<\/p>\n<p>Data Centers \u2013 Centralized facilities that house servers, storage systems, and networking equipment. The data center provides a controlled environments with power, cooling, and security features to ensure optimal performance and data protection.<\/p>\n<p>Cloud Systems \u2013 Cloud computing services, including Infrastructure as a Service (IaaS), Platform as a Service (PaaS), and Software as a Service (SaaS), offer scalable and flexible solutions for infrastructure requirements.<\/p>\n<p>Security Systems \u2013 Infrastructure security measures like firewalls, antivirus software, intrusion detection systems, and encryption technologies protect against unauthorized access, data breaches, and cyber threats.<\/p>\n<p>IT Service Management (ITSM) \u2013 ITSM frameworks and tools enable efficient management of IT services, including incident management, change management, problem management, and service desk support.<\/p>\n<p>Cybersecurity System \u2013 Cybersecurity refers to any technologies, practices and policies for preventing\u00a0<a href=\"https:\/\/www.ibm.com\/think\/topics\/cyber-attack\">cyberattacks<\/a>\u00a0or mitigating their impact. Cybersecurity aims to protect computer systems, applications, devices, data, financial assets and people against\u00a0<a href=\"https:\/\/www.ibm.com\/think\/topics\/ransomware\">ransomware<\/a>\u00a0and other\u00a0<a href=\"https:\/\/www.ibm.com\/think\/topics\/malware\">malware<\/a>,\u00a0<a href=\"https:\/\/www.ibm.com\/think\/topics\/phishing\">phishing<\/a>\u00a0scams, data theft and other cyberthreats.<\/div><\/div><\/div><div class=\"fusion-panel panel-default fusion-toggle-no-divider\"><div class=\"panel-heading\"><h4 class=\"panel-title toggle\"><a aria-expanded=\"false\" aria-controls=\"a2d1302606a6ce900\" role=\"button\" data-toggle=\"collapse\" data-parent=\"#accordion-19091-1\" data-target=\"#a2d1302606a6ce900\" href=\"#a2d1302606a6ce900\"><span class=\"fusion-toggle-icon-wrapper\" aria-hidden=\"true\"><i class=\"fa-fusion-box\" aria-hidden=\"true\"><\/i><\/span><span class=\"fusion-toggle-heading\">Are PVAMU faculty and staff employees allowed to travel to the designated countries to attend conferences or meetings, or to conduct other official university business?<\/span><\/a><\/h4><\/div><div id=\"a2d1302606a6ce900\" class=\"panel-collapse collapse \"><div class=\"panel-body toggle-content fusion-clearfix\">\n<p>No. At this time, faculty and staff employees are prohibited from traveling to these countries to conduct official university business. The executive order does not apply to business travel to Venezuela.<\/p>\n<\/div><\/div><\/div><div class=\"fusion-panel panel-default fusion-toggle-no-divider\"><div class=\"panel-heading\"><h4 class=\"panel-title toggle\"><a aria-expanded=\"false\" aria-controls=\"4044d8a845243079a\" role=\"button\" data-toggle=\"collapse\" data-parent=\"#accordion-19091-1\" data-target=\"#4044d8a845243079a\" href=\"#4044d8a845243079a\"><span class=\"fusion-toggle-icon-wrapper\" aria-hidden=\"true\"><i class=\"fa-fusion-box\" aria-hidden=\"true\"><\/i><\/span><span class=\"fusion-toggle-heading\">May PVAMU faculty and staff employees travel to the designated countries to conduct official business if the designated country pays for the travel?<\/span><\/a><\/h4><\/div><div id=\"4044d8a845243079a\" class=\"panel-collapse collapse \"><div class=\"panel-body toggle-content fusion-clearfix\">\n<p>No. The executive order prohibits employees of all Texas public universities and state agencies from accepting any and all gifts from the designated countries, including paying for travel expenses.<\/p>\n<\/div><\/div><\/div><div class=\"fusion-panel panel-default fusion-toggle-no-divider\"><div class=\"panel-heading\"><h4 class=\"panel-title toggle\"><a aria-expanded=\"false\" aria-controls=\"269831a6ba17ce610\" role=\"button\" data-toggle=\"collapse\" data-parent=\"#accordion-19091-1\" data-target=\"#269831a6ba17ce610\" href=\"#269831a6ba17ce610\"><span class=\"fusion-toggle-icon-wrapper\" aria-hidden=\"true\"><i class=\"fa-fusion-box\" aria-hidden=\"true\"><\/i><\/span><span class=\"fusion-toggle-heading\">Does Executive Order GA-48 prohibit PVAMU faculty and staff employees from traveling to the designated countries for personal reasons?<\/span><\/a><\/h4><\/div><div id=\"269831a6ba17ce610\" class=\"panel-collapse collapse \"><div class=\"panel-body toggle-content fusion-clearfix\">\n<p>No. Faculty and staff employees may travel to the designated countries for personal reasons. However, the order requires individuals to notify the university before departing to one of the countries on personal travel. The executive order also requires individuals to provide certain information about the trip upon return. The executive order does not apply to personal travel to Venezuela.<\/p>\n<\/div><\/div><\/div><div class=\"fusion-panel panel-default fusion-toggle-no-divider\"><div class=\"panel-heading\"><h4 class=\"panel-title toggle\"><a aria-expanded=\"false\" aria-controls=\"9e9ba40c43bd1ce3d\" role=\"button\" data-toggle=\"collapse\" data-parent=\"#accordion-19091-1\" data-target=\"#9e9ba40c43bd1ce3d\" href=\"#9e9ba40c43bd1ce3d\"><span class=\"fusion-toggle-icon-wrapper\" aria-hidden=\"true\"><i class=\"fa-fusion-box\" aria-hidden=\"true\"><\/i><\/span><span class=\"fusion-toggle-heading\">How do I provide the pre-travel notice?<\/span><\/a><\/h4><\/div><div id=\"9e9ba40c43bd1ce3d\" class=\"panel-collapse collapse \"><div class=\"panel-body toggle-content fusion-clearfix\">Faculty and staff employees must provide the required notice through Workday using the following Workday process:<\/p>\n<p>Step 1: Login to Workday.<\/p>\n<p>Step 2: In the search window type \u201cCreate Request\u201d and press \u201cEnter\u201d<\/p>\n<p>Step 3: In the search results, under Tasks and Reports, select \u201cCreate Request\u201d<\/p>\n<p>Step 4: When the dialog box appears, select the search window and then select \u201cAll\u201d as the \u201cRequest Type\u201d from the drop-down menu.<\/p>\n<p>Step 5: Select \u201cCertification of Travel to a Foreign-Adversary\u201d and then select OK.<\/p>\n<p>Step 6: Answer the following questions in the form:<\/p>\n<p>-When do you intend to leave for travel?<\/p>\n<p>-When do you plan to return from travel?<\/p>\n<p>-Where do you intend to travel?<\/p>\n<p>-Enter any other comments<\/p>\n<p>The manager will receive a task and acknowledges receipt by submitting the task.<\/p>\n<p>A task is triggered for the employee to complete a post-travel brief, and it remains in their Workday inbox until they return to work.<\/div><\/div><\/div><div class=\"fusion-panel panel-default fusion-toggle-no-divider\"><div class=\"panel-heading\"><h4 class=\"panel-title toggle\"><a aria-expanded=\"false\" aria-controls=\"f012d139c16f7b563\" role=\"button\" data-toggle=\"collapse\" data-parent=\"#accordion-19091-1\" data-target=\"#f012d139c16f7b563\" href=\"#f012d139c16f7b563\"><span class=\"fusion-toggle-icon-wrapper\" aria-hidden=\"true\"><i class=\"fa-fusion-box\" aria-hidden=\"true\"><\/i><\/span><span class=\"fusion-toggle-heading\">How do I provide the post-travel information?<\/span><\/a><\/h4><\/div><div id=\"f012d139c16f7b563\" class=\"panel-collapse collapse \"><div class=\"panel-body toggle-content fusion-clearfix\">Faculty and staff employees must provide the required post-travel information through Workday using the following Workday process:<\/p>\n<p>Upon submission of the required pre-travel report in Workday, a task is triggered for the employee to complete a post-travel brief, and it remains in their Workday inbox until they return to work.<\/p>\n<p>Upon the employee\u2019s return to work, the employee completes a similar post-travel questionnaire and selects submit.<\/p>\n<p>The manager receives notification of the post-travel brief and closes the request.<\/div><\/div><\/div><div class=\"fusion-panel panel-default fusion-toggle-no-divider\"><div class=\"panel-heading\"><h4 class=\"panel-title toggle\"><a aria-expanded=\"false\" aria-controls=\"9862000edffcc9ced\" role=\"button\" data-toggle=\"collapse\" data-parent=\"#accordion-19091-1\" data-target=\"#9862000edffcc9ced\" href=\"#9862000edffcc9ced\"><span class=\"fusion-toggle-icon-wrapper\" aria-hidden=\"true\"><i class=\"fa-fusion-box\" aria-hidden=\"true\"><\/i><\/span><span class=\"fusion-toggle-heading\">How will PVAMU use the pre-travel and post-travel information?<\/span><\/a><\/h4><\/div><div id=\"9862000edffcc9ced\" class=\"panel-collapse collapse \"><div class=\"panel-body toggle-content fusion-clearfix\">\n<p>The information is being collected solely for the purpose of complying with Executive Order GA-48. Listed in Section 889 of the 2019 National Defense Authorization Act (NDAA); or<\/p>\n<p>b. Listed in Section 1260H of the 2021 NDAA; or<\/p>\n<p>c. Owned by the government of a country on the U.S. Department of Commerce\u2019s foreign adversaries list under 15 C.F.R. \u00a7 791.4; or<\/p>\n<p>d. Controlled by any governing or regulatory body located in a country on the U.S. Department of Commerce\u2019s foreign adversaries list under 15 C.F.R. \u00a7 791.4.<\/div><\/div><\/div><div class=\"fusion-panel panel-default fusion-toggle-no-divider\"><div class=\"panel-heading\"><h4 class=\"panel-title toggle\"><a aria-expanded=\"false\" aria-controls=\"240dfff16c88ebab4\" role=\"button\" data-toggle=\"collapse\" data-parent=\"#accordion-19091-1\" data-target=\"#240dfff16c88ebab4\" href=\"#240dfff16c88ebab4\"><span class=\"fusion-toggle-icon-wrapper\" aria-hidden=\"true\"><i class=\"fa-fusion-box\" aria-hidden=\"true\"><\/i><\/span><span class=\"fusion-toggle-heading\">What should I do if I have an existing contract that meets one of these restrictions?<\/span><\/a><\/h4><\/div><div id=\"240dfff16c88ebab4\" class=\"panel-collapse collapse \"><div class=\"panel-body toggle-content fusion-clearfix\">\n<p>If an employee is aware of an existing contract that meets one of these restrictions, they must contact University Ethics and Compliance (by emailing universitycompliance@pvamu.edu) who will coordinate a review with the Purchasing and Contracts office. This review will consider whether PVAMU can continue to use the vendor, what options exist to obtain the good or service from a different company, or if a different service is explored in order to meet the need if it is mission critical to the organization.<\/p>\n<\/div><\/div><\/div><div class=\"fusion-panel panel-default fusion-toggle-no-divider\"><div class=\"panel-heading\"><h4 class=\"panel-title toggle\"><a aria-expanded=\"false\" aria-controls=\"15605bdacb7a36ac4\" role=\"button\" data-toggle=\"collapse\" data-parent=\"#accordion-19091-1\" data-target=\"#15605bdacb7a36ac4\" href=\"#15605bdacb7a36ac4\"><span class=\"fusion-toggle-icon-wrapper\" aria-hidden=\"true\"><i class=\"fa-fusion-box\" aria-hidden=\"true\"><\/i><\/span><span class=\"fusion-toggle-heading\">What other Contract Administration requirements are placed on the university?<\/span><\/a><\/h4><\/div><div id=\"15605bdacb7a36ac4\" class=\"panel-collapse collapse \"><div class=\"panel-body toggle-content fusion-clearfix\">Successful bidders of goods or services will be required to certify to the following (or similar statement approved by TAMUS):<\/p>\n<p>Respondent certifies that pursuant to Executive Order GA-48, Hardening of State Government, Respondent is not and, if applicable, none of its holding companies or subsidiaries or subcontractors are a) listed in Section 889 of the 2019 National Defense Authorization Act (\u201cNDAA\u201d) regarding telecommunications and video surveillance; b) listed in Section 1260H of the 2021 NDAA regarding Chinese military companies in the US; c) owned by the government of a country on the U.S. Department of Commerce\u2019s foreign adversaries list under 15 C.F.R. \u00a7 791.4 (\u201c15 C.F.R. \u00a7 791.4 List\u201d); or d) controlled by any governing or regulatory body located in a country on the 15 C.F.R. \u00a7 791.4 List. Respondent acknowledges that a false certification is grounds for immediate termination of any resulting contract or purchase order with no further obligation on the part of A&amp;M System.<\/div><\/div><\/div><div class=\"fusion-panel panel-default fusion-toggle-no-divider\"><div class=\"panel-heading\"><h4 class=\"panel-title toggle\"><a aria-expanded=\"false\" aria-controls=\"cd6b49582d565560c\" role=\"button\" data-toggle=\"collapse\" data-parent=\"#accordion-19091-1\" data-target=\"#cd6b49582d565560c\" href=\"#cd6b49582d565560c\"><span class=\"fusion-toggle-icon-wrapper\" aria-hidden=\"true\"><i class=\"fa-fusion-box\" aria-hidden=\"true\"><\/i><\/span><span class=\"fusion-toggle-heading\">The following contract language (or similar language approved by A&amp;M System) will be inserted into all applicable contracts, agreements, mou\u2019s, etc.:<\/span><\/a><\/h4><\/div><div id=\"cd6b49582d565560c\" class=\"panel-collapse collapse \"><div class=\"panel-body toggle-content fusion-clearfix\">To the extent that Executive Order GA-48, Hardening of State Government, is applicable to this Agreement, [CONTRACTING PARTY] represents and warrants that [CONTRACTING PARTY] is not and, if applicable, none of its holding companies or subsidiaries or subcontractors are a) listed in Section 889 of the 2019 National Defense Authorization Act (\u201cNDAA\u201d) regarding telecommunications and video surveillance; b) listed in Section 1260H of the 2021 NDAA regarding Chinese military companies in the US; c) owned by the government of a country on the U.S. Department of Commerce\u2019s foreign adversaries list under 15 C.F.R. \u00a7 791.4 (\u201c15 C.F.R. \u00a7 791.4 List\u201d); or d) controlled by any governing or regulatory body located in a country on the 15 C.F.R. \u00a7 791.4 List. The Panther Alert System will remain in place, but will provide an enhanced user experience.<\/p>\n<p>Rave Guardian is a free mobile app that turns your smartphone into a personal safety device and Rave Alert Mobile allows for phone calls, text messages and emails related to campus safety to be distributed to the campus community.<\/p>\n<p>As a faculty\/staff and student, you are <strong>automatically<\/strong> enrolled in RAVE Alert Mobile.<\/p>\n<p>The Rave Guardian App has a safety feature that directly connects you to PVAMU Police in an emergency, as well as the ability to submit an anonymous tip to PVAMU Police should you see something suspicious. The Guardian will receive an invitation via text with a link to download the app. They must accept you to be a Guardian.
