SART intervenes in a way that speaks to the context of each victim&#8217;s circumstance and respects the unique roles of the different professionals involved in responding to sexual assault. Our SART consists of a group of institutional leaders who partner together to provide interagency, coordinated responses that make victims\u2019 needs a priority, promote safety, and encourage significant prevention and education initiatives concerning sexual assault.<\/p>\n<p><strong>SART MEMBERS include representatives from each of these specific areas:<\/strong><\/p>\n<ul>\n<li>College of Agriculture and Human Services<\/li>\n<li>College of Business<\/li>\n<li>College of Engineering<\/li>\n<li>College of Nursing<\/li>\n<li>College of Education<\/li>\n<li>College of Arts and Services<\/li>\n<li>College of Education<\/li>\n<li>College of Juvenile Justice<\/li>\n<li>Dean of Students<\/li>\n<li>Health Services<\/li>\n<li>Student Counseling Center<\/li>\n<li>Women\u2019s Center<\/li>\n<li>Athletics<\/li>\n<li>University Police Department<\/li>\n<li>Office of Title IX<\/li>\n<\/ul>\n<p><strong>HOW SART HELPS<\/strong><\/p>\n<p>SARTs can diminish the short and long term impacts of trauma by mobilizing interdisciplinary expertise to assess and address victims&#8217; needs from the acute stage to recovery. The cooperative partnerships formed by SARTs can validate victims&#8217; concerns, inform victims of available options for addressing their concerns, and improve service accessibility for diverse populations. More specifically, SARTs help victims by, among other activities:<\/p>\n<ul>\n<li>Supporting victims during invasive medical procedures and difficult interviews.<\/li>\n<li>Supporting victims emotionally as they navigate the criminal justice system.<\/li>\n<li>Designating specific facilities for forensic medical exams that make timely responses a priority and offer victims privacy.<\/li>\n<li>Providing medical assessments and prophylactic treatment for sexually transmitted infections and addressing reproductive health concerns.<\/li>\n<li>Ensuring that medical and legal providers collect evidence effectively and follow a\u00a0<a href=\"https:\/\/www.ncjrs.gov\/ovc_archives\/sartkit\/develop\/issues-coc.html\">chain of custody<\/a>\u00a0so that it stands up in court.<\/li>\n<li>Building a network of community referrals to meet victims&#8217; practical, emotional, spiritual, and economic needs (e.g., temporary shelter, transportation, employment intervention, home security, assistance with restitution, and victims&#8217; compensation claims).<\/li>\n<li>Minimizing the re-traumatization of victims, often through joint or coordinated interviews to reduce the number of times victims must tell their stories.<\/li>\n<\/ul>\n<p><strong>WHAT SART DOES<\/strong><\/p>\n<p>There are 5 core areas of focus for the team:<\/p>\n<ul>\n<li>Support victims&#8217; rights.<\/li>\n<li>Commit to meeting victims&#8217; needs.<\/li>\n<li>Organize service delivery to enhance evidence collection.<\/li>\n<li>Educate the community about available intervention and prevention services.<\/li>\n<li>Take action to create a culture absent of sexual assault and violence.<\/li>\n<\/ul>\n<p><strong>WHY SART MATTERS<\/strong><\/p>\n<p>Cases that involve SARTs\u2014<\/p>\n<ul>\n<li>Are reported more quickly.<\/li>\n<li>Have more evidence (in particular, DNA evidence).<\/li>\n<li>Are the strongest predictor that charges will be filed in sexual assault cases with adult female victims.<\/li>\n<li>Yield more evidence on average than cases in which no SANE or SART intervention occurs.<\/li>\n<li>Are more likely to lead to arrest than cases in which there is no intervention.<\/li>\n<li>Have personnel who keep victims better informed and engaged throughout the criminal justice process.<\/li>\n<\/ul>\n<p>Want to collaborate with us? Do both the Complainant and the Respondent in a Title IX case get a Title IX Advisor?<\/span><\/a><\/h4><\/div><div id=\"fec7465692ae1efde\" class=\"panel-collapse collapse \" aria-labelledby=\"toggle_fec7465692ae1efde\"><div class=\"panel-body toggle-content fusion-clearfix\">\n<p>Yes, both parties have the right to a Title IX Advisor of their choosing. Each party may select whomever they wish to serve as their Title IX Advisor, as long as the Title IX Advisor is eligible and has no institutionally conflicting roles (such as being a Title IX Coordinator, a supervisor who would implement sanctions in the event of a finding of responsibility, or a witness in the process).<\/p>\n<\/div><\/div><\/div><div class=\"fusion-panel panel-default panel-6781efa4f7712eed5 fusion-toggle-no-divider\"><div class=\"panel-heading\"><h4 class=\"panel-title toggle\" id=\"toggle_6781efa4f7712eed5\"><a aria-expanded=\"false\" aria-controls=\"6781efa4f7712eed5\" role=\"button\" data-toggle=\"collapse\" data-parent=\"#accordion-1545-2\" data-target=\"#6781efa4f7712eed5\" href=\"#6781efa4f7712eed5\"><span class=\"fusion-toggle-icon-wrapper\" aria-hidden=\"true\"><i class=\"fa-fusion-box active-icon awb-icon-minus\" aria-hidden=\"true\"><\/i><i class=\"fa-fusion-box inactive-icon awb-icon-plus\" aria-hidden=\"true\"><\/i><\/span><span class=\"fusion-toggle-heading\">3. Who can serve as a Title IX Advisor?<\/span><\/a><\/h4><\/div><div id=\"6781efa4f7712eed5\" class=\"panel-collapse collapse \" aria-labelledby=\"toggle_6781efa4f7712eed5\"><div class=\"panel-body toggle-content fusion-clearfix\">\n<p>The\u00a0Title IX\u00a0Advisor may be a friend, family member, attorney, neighbor, or other individual. Prairie View A &amp; M University has a list of trained Advisors who stand ready to serve if selected by a party. Trained\u00a0Title IX\u00a0Advisors are familiar with the PVAMU Title IX process as well as how to best serve in their\u00a0Title IX\u00a0Advisor role. If a party chooses a\u00a0Title IX\u00a0Advisor from outside the pool of trained PVAMU Title IX\u00a0Advisors, they would not have been trained and may not be familiar with PVAMU \u2019s policies and procedures.<\/p>\n<p>Parties also have the right to choose not to have a\u00a0Title IX\u00a0Advisor in the initial stages of the resolution process, but at the hearing stage, the party without a\u00a0Title IX\u00a0Advisor would be appointed\u00a0Title IX\u00a0Advisor to conduct the cross-examination during the hearing. The party can reject the appointed\u00a0Title IX\u00a0Advisor in favor of selecting their own\u00a0Title IX\u00a0Advisor, but the party cannot proceed in the hearing without a\u00a0Title IX\u00a0Advisor present. This is the case because the parties are not permitted to directly cross-examine each other or any witness.<\/p>\n<\/div><\/div><\/div><div class=\"fusion-panel panel-default panel-44e1ac7bdd4758832 fusion-toggle-no-divider\"><div class=\"panel-heading\"><h4 class=\"panel-title toggle\" id=\"toggle_44e1ac7bdd4758832\"><a aria-expanded=\"false\" aria-controls=\"44e1ac7bdd4758832\" role=\"button\" data-toggle=\"collapse\" data-parent=\"#accordion-1545-2\" data-target=\"#44e1ac7bdd4758832\" href=\"#44e1ac7bdd4758832\"><span class=\"fusion-toggle-icon-wrapper\" aria-hidden=\"true\"><i class=\"fa-fusion-box active-icon awb-icon-minus\" aria-hidden=\"true\"><\/i><i class=\"fa-fusion-box inactive-icon awb-icon-plus\" aria-hidden=\"true\"><\/i><\/span><span class=\"fusion-toggle-heading\">4. What is a Title IX Advisor\u2019s role in the investigative process?<\/span><\/a><\/h4><\/div><div id=\"44e1ac7bdd4758832\" class=\"panel-collapse collapse \" aria-labelledby=\"toggle_44e1ac7bdd4758832\"><div class=\"panel-body toggle-content fusion-clearfix\">\n<p>The parties may be accompanied by their\u00a0Title IX\u00a0Advisor in all meetings and interviews at which the party is entitled to be present.\u00a0Title IX\u00a0Advisors should help the parties prepare for the meetings and interviews.\u00a0Title IX\u00a0Advisors are expected to advise ethically and with integrity (i.e., not permitting a party to lie or to present false evidence).<\/p>\n<p>The PVAMU cannot guarantee equal\u00a0Title IX\u00a0advisory experiences, meaning that if one party hires an attorney to serve as their\u00a0Title IX\u00a0Advisor and the other party does not hire an attorney, then PVAMU is not obligated to provide an attorney Advisor for the other party.<\/p>\n<p>Also, if one party selects a\u00a0Title IX\u00a0Advisor from the sPVAMU list of\u00a0Title IX\u00a0Advisors and the other party selects a family member as an Advisor, the PVAMU Title IX\u00a0Advisor would have received training in order to serve in this capacity while the family member Advisor would not have received such training. The PVAMU is not obligated to train the family member Advisor.<\/p>\n<p>All\u00a0Title IX\u00a0Advisors are subject to the same PVAMU policies and procedures, whether they are attorneys or not.\u00a0Title IX\u00a0Advisors are expected to advise <u>without disrupting proceedings<\/u>.\u00a0Title IX\u00a0Advisors should not address the PVAMU officials in a meeting or interview unless they are permitted to do so by the investigators\u2014for instance to ask procedural questions.<\/p>\n<p>Title IX\u00a0Advisors are not permitted to make presentations or opening\/closing statements during any meeting or proceeding (including during a hearing).\u00a0Title IX\u00a0Advisors are also prohibited from speaking on behalf of the advisee to the Investigator(s) or the Decision-maker (at a hearing), except during the cross-examination at the hearing.<\/p>\n<p>Although the\u00a0Title IX\u00a0Advisor generally may not speak on behalf of their advisee, the\u00a0Title IX\u00a0Advisor may consult with their advisee, either privately as needed, or by conferring or passing notes during any resolution process meeting or interview. For longer or more involved discussions, the parties and their\u00a0Title IX\u00a0Advisors should ask for breaks to allow for private consultation.<\/p>\n<\/div><\/div><\/div><div class=\"fusion-panel panel-default panel-6298ed9c7f5dd0485 fusion-toggle-no-divider\"><div class=\"panel-heading\"><h4 class=\"panel-title toggle\" id=\"toggle_6298ed9c7f5dd0485\"><a aria-expanded=\"false\" aria-controls=\"6298ed9c7f5dd0485\" role=\"button\" data-toggle=\"collapse\" data-parent=\"#accordion-1545-2\" data-target=\"#6298ed9c7f5dd0485\" href=\"#6298ed9c7f5dd0485\"><span class=\"fusion-toggle-icon-wrapper\" aria-hidden=\"true\"><i class=\"fa-fusion-box active-icon awb-icon-minus\" aria-hidden=\"true\"><\/i><i class=\"fa-fusion-box inactive-icon awb-icon-plus\" aria-hidden=\"true\"><\/i><\/span><span class=\"fusion-toggle-heading\">5. What happens if a Title IX Advisor breaks the rules outlined in Question #4?<\/span><\/a><\/h4><\/div><div id=\"6298ed9c7f5dd0485\" class=\"panel-collapse collapse \" aria-labelledby=\"toggle_6298ed9c7f5dd0485\"><div class=\"panel-body toggle-content fusion-clearfix\">\n<p>Any Title IX Advisor who oversteps their role as defined by this policy will be warned only once. If the Title IX Advisor continues to disrupt or otherwise fails to respect the limits of the Title IX Advisor role, the meeting will be ended and the Title IX Coordinator will determine how to address the Title IX Advisor\u2019s non-compliance moving forward. The Title IX Coordinator may prohibit the Title IX Advisor from continuing to act in that capacity in future meetings\/proceedings. Is my Title IX Advisor allowed access to information collected as evidence during the Title IX case?<\/span><\/a><\/h4><\/div><div id=\"2a1a670d6e091cb22\" class=\"panel-collapse collapse \" aria-labelledby=\"toggle_2a1a670d6e091cb22\"><div class=\"panel-body toggle-content fusion-clearfix\">\n<p>PVAMU expects that the parties may wish to shave documentation and evidence related to the allegations of Title IX sexual harassment with their Title IX Advisors. Parties may share this information directly with their Title IX Advisor or other individuals, if they wish. If the party wants the PVAMU to share documentation and evidence with Title IX Advisors, the PVAMU will provide the party with a FERPA authorization to disclose consent form to sign. The authorization will remain in the Title IX file.<\/p>\n<p>If a party requests that all communication be made through their Attorney Advisor, PVAMU will <strong>not<\/strong> comply with that request. It is assumed that if a party changes Title IX Advisors, consent to share information with the previous Title IX Advisor is terminated, and a release for the new Title IX Advisor must be secured.<\/p>\n<p>Parties are expected to inform the Title IX Coordinator of the identity of the new Title IX Advisor at least two (2) days before a meeting where the party and their Title IX Advisor is to be present. This prohibition applies to specific classes such as advanced placement or honors classes, extracurricular programs, interscholastic sports, honor societies, and opportunities for student leadership, among other activities.<\/p>\n<p>Any special services provided to students who have temporary medical conditions must also be provided to a pregnant student. However, the university is aware that there will be times when a student is unable to attend class due to pregnancy or parenting as a result of pregnancy. For a full description of the investigation process, see <a href=\"http:\/\/policies.tamus.edu\/08-01-01.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">TAMUS Regulation 08.01.01<\/a>.<\/p>\n<h2 data-fontsize=\"28\" style=\"--fontSize: 28;line-height: 1.25\" data-lineheight=\"35px\" class=\"fusion-responsive-typography-calculated\">Stage 1 &#8211; Intake<\/h2>\n<p>When the Office of Title IX Compliance receives an allegation of sex-based discrimination or harassment, the Title IX Coordinator, or a designee, will contact the Complainant and invite them to an intake meeting.  At the intake meeting, a Title IX staff member will listen and document the Complainant\u2019s concerns and  explain to the Complainant their rights, resources, and options. If the Complainant requests a resolution of the allegations, the Title IX Coordinator will determine whether the allegations, if true, would be a violation of <a href=\"http:\/\/policies.tamus.edu\/08-01-01.pdf\">Texas A&amp;M System Regulation 08.01.01<\/a> or any other university policy. If so, the Office of Title IX Compliance will proceed with a resolution.<\/p>\n<p>If a formal resolution is sought, the Title IX Coordinator, or a designee, will notify all parties that an investigation has commenced.  The Respondent will also be invited to our offices for an intake meeting.  After listening to the Respondent\u2019s concerns, a Title IX staff member will provide the Respondent with information about their rights, resources, and options during the investigation and resolution process.<\/p>\n<h2 data-fontsize=\"28\" style=\"--fontSize: 28;line-height: 1.25\" data-lineheight=\"35px\" class=\"fusion-responsive-typography-calculated\">Stage 2 &#8211; Investigation<\/h2>\n<p>During the investigation phase, the investigator will gather all information and evidence relevant to the allegations. This includes interviewing the Complainant(s), Respondent(s), and Witnesses. The Investigator will also collect any relevant documentation, electronic evidence or other evidence related to the allegations.<\/p>\n<p>Once the report is finalized, the investigator will forward it to the university\u2019s Designated Administrator. In cases of alleged student misconduct, the Designated Administrator is generally the Office of Student Conduct. The report may conclude one of the following about each allegation:<\/p>\n<ul>\n<li>Substantiated \u2013 it is more likely than not that the alleged conduct occurred<\/li>\n<li>Unsubstantiated \u2013 it is more likely than not that the alleged conduct did not occur<\/li>\n<li>Unsubstantiated due to insufficient information \u2013 there was insufficient evidence to decide whether it is more likely than not that the alleged conduct occurred<\/li>\n<\/ul>\n<h2 data-fontsize=\"28\" style=\"--fontSize: 28;line-height: 1.25\" data-lineheight=\"35px\" class=\"fusion-responsive-typography-calculated\">Stage 3 &#8211; Determination<\/h2>\n<p>The Designated Administrator will review the report and exhibits prior to making a determination on responsibility. In cases of student misconduct, the Designated Administrator may conduct a hearing before determining responsibility. The Designated Administrator will also assign sanctions, if applicable.<\/p>\n<p>In cases of student misconduct, both parties will have access to review the investigation report and exhibits prior to a decision being rendered. When an employee is accused, the Respondent may review the investigation report and exhibits after a decision has been rendered. In every case, the Complainant and Respondent will receive written notice of the Designated Administrator&#8217;s decision.<\/p>\n<h2 data-fontsize=\"28\" style=\"--fontSize: 28;line-height: 1.25\" data-lineheight=\"35px\" class=\"fusion-responsive-typography-calculated\">Stage 4 &#8211; Appeal<\/h2>\n<p>A party has five business days after the determination of responsibility to file an appeal. The bases for appeal are limited to the following:<\/p>\n<ol>\n<li>There is new evidence that was unknown or unavailable during the investigation that could have significantly impacted the outcome;<\/li>\n<li>There was a procedural error or omission that significantly impacted the outcome; and\/or<\/li>\n<li>A party would like to contest the appropriateness or severity of the sanctions.<\/li>\n<\/ol>\n<p>If an employee is found to have sexually harassed (including non-consensual sexual contact, sexual assault, sexual exploitation, stalking, dating violence, and domestic violence when based on sex) another member of the university or agency community, the third basis for appeal (appropriateness or severity of sanctions) is not available as a basis for appeal.<\/p>\n<p>Appeals are reviewed by an Appellate Authority, who has had no previous involvement or participation with the investigation. The Appellate Authority may uphold or overturn previous decisions in the
