Progressive discipline may be used in accordance with:<\/p>\n<ul>\n<li>System Regulation\u00a0<a href=\"https:\/\/policies.tamus.edu\/32-02-02.pdf\">32.02.02: Discipline and Dismissal of Nonfaculty Employees<\/a><\/li>\n<\/ul>\n<p>This procedure describes the use of progressive discipline in resolving problems through\u00a0<strong>corrective action<\/strong>. The University also recognizes that misconduct, violations of policies and procedures, and continued failure to correct performance problems may require\u00a0<strong>disciplinary action<\/strong>. This procedure defines the delegation of authority to approve corrective and disciplinary action and dismissals for nonfaculty employees and describes procedures unique to Prairie View A&amp;M University in the administration of the discipline and dismissal policy and regulation.<\/p>\n<h2><strong>Definitions of Progressive Discipline Actions<\/strong><\/h2>\n<p><strong>Personnel Corrective Action<\/strong><\/p>\n<p>An employment action not affecting pay or status; addressing inappropriate job-related conduct or performance with employee and providing guidance on returning to acceptable standards. It is recommended that departments consult with Employee Relations when considering corrective action.<\/p>\n<p><strong>Personnel Disciplinary Action<\/strong><\/p>\n<p>An employment action affecting pay or status; addressing more serious incidents of inappropriate job-related conduct or performance or if corrective action does not achieve desired results. Employee Relations must review and consult with the System Office of General Counsel before disciplinary action may be taken.<\/p>\n<h2><strong>Process<\/strong><\/h2>\n<p><strong>Coaching Session<\/strong><\/p>\n<p>This is the first step in working to respond to a performance problem (e.g., unacceptable attendance, unsatisfactory job performance or inappropriate conduct) which would result in a coaching session. Your coaching session is the most effective way to deal with a small problem before it gets out of hand and turns into a disciplinary action. The goal of these coaching sessions is to help the employee understand and work to resolve the problem so that their performance is improved. As the manager, you should help to address specific areas in which the employee&#8217;s job performance and\/or conduct must improve. This is an opportunity for the employee to:<\/p>\n<ol>\n<li>Recognize that there is a problem,<\/li>\n<li>Understand the nature of the problem,<\/li>\n<li>Acknowledge that they need to correct the problem,\u00a0<em>and<\/em><\/li>\n<li>Understand what the consequences are if the problem continues.<\/li>\n<\/ol>\n<p>The manager should document their conversation on the\u00a0<a href=\"http:\/\/www.pvamu.edu\/hr\/wp-content\/uploads\/sites\/44\/PVHR_ManagersNotes.docx\">Managers&#8217; Notes<\/a>.<\/p>\n<p><strong>First Disciplinary Action<\/strong><\/p>\n<ul>\n<li>If the employee&#8217;s performance\/conduct does not improve, the manager should with the employee to make sure they understand what changes are needed of them to correct the specific deficiencies. However, job candidates can be asked if they can perform specific job responsibilities and how they would go about accomplishing those tasks with or without an accommodation.<\/p>\n<p><strong>What is considered a disability?<\/strong><\/p>\n<p>A disability is a:<\/p>\n<ul>\n<li>physical or mental impairment which substantially limits one or more major life activities such as walking, seeing, hearing, breathing, bending, lifting, or<\/li>\n<li>employee has a record of such impairment or is regarded as having such an impairment<strong>.<\/strong><\/li>\n<\/ul>\n<p><strong>What are essential job functions?<\/strong><\/p>\n<p>Essential job functions are the fundamental and critical responsibilities performed in a position.  Factors to consider in determining if a function is essential include but are not limited to whether:<\/p>\n<ul>\n<li>The function requires specialized<\/li>\n<li>A significant amount of time is spent performing the<\/li>\n<li>There is a limited amount of people who can perform the<\/li>\n<li>There is a significant consequence if the function is not performed; or<\/li>\n<li>The reason the job exists is to perform that For example, an essential function of a shuttle driver is to drive a bus.<\/li>\n<\/ul>\n<p><strong>Must I request an accommodation if I have a disability?<\/strong><\/p>\n<ul>\n<li>No, requesting an accommodation is not required if the employee feels that an accommodation is not It is the employee&#8217;s decision whether to request an accommodation.<\/li>\n<li>It is recommended that IWD voluntarily self-identify for report purposes only.<\/li>\n<\/ul>\n<p><strong>My supervisor is already accommodating me.  Why do I need to <\/strong><strong>fill out the paperwork?<\/strong><\/p>\n<ul>\n<li>Prairie View A&amp;M University has a process in place to ensure fair treatment for all employees requesting reasonable ADA Following the process also enables the University to ensure that it is fully compliant with its obligations under the ADA.<\/li>\n<\/ul>\n<p><strong>What do reasonable accommodations look like?<\/strong><\/p>\n<ul>\n<li>Requests for a &#8220;reasonable ADA accommodation&#8221; will be analyzed on a case-by-case basis, after consultation with the employee, the employee&#8217;s health care provider(s), and the Examples of reasonable ADA accommodations may include, but are not limited to, the purchase of special equipment, changing the physical layout of the workplace, restructuring job responsibilities and duties, and modifying the work schedule.<\/li>\n<li>If a requested accommodation would result in an undue hardship, the University does not have to provide the The EEOC defines \u00b7undue hardship&#8221; as an accommodation that \u00b7would be unduly costly, extensive, substantial or disruptive, or would fundamentally alter the nature or operation of the business.&#8221; If a requested accommodation presents an undue hardship, the Office of Equal Opportunity (EEO) will work with the employee and the department to determine whether alternative accommodations are available.<\/li>\n<\/ul>\n<p><strong>What happens after an employee requests a reasonable <\/strong><strong>ADA accommodation?<\/strong><\/p>\n<ul>\n<li>Employees will be asked to complete an ADA Accommodation Request Form as well as a Medical Information **<strong>Note: Documentation is not required when an employee\u2019s disability and need for accommodation are both obvious.<br \/><\/strong><\/li>\n<li>Employees also have the option of submitting a letter from their health care In some cases, there may be a need for the ADA Coordinator to contact the employee&#8217;s health care provider to verify the medical condition and the need for accommodation &#8211; if the disability is not obvious.<\/li>\n<li>The employee&#8217;s supervisor will be informed of the accommodation request and will be engaged in an interactive process to discuss effective work accommodations, the essential functions of the position, and the department&#8217;s operational<\/li>\n<li>Although the employee provides input concerning the accommodation process, EEO will determine what constitutes a reasonable accommodation on a case-by-case While EEO will take the employee&#8217;s preferred accommodation into account when possible, EEO <em>may <\/em>opt to approve a different accommodation that would also meet the employee&#8217;s needs.<\/li>\n<li>When an accommodation is granted the employee will receive an approval notice. If an accommodation is not granted, both the employee and the employee&#8217;s department are provided with an explanation for the denial.  EEO will collaborate with the employee and the department to determine whether alternative accommodations are available.<\/li>\n<\/ul>\n<p><strong>Will my medical information remain confidential?<\/strong><\/p>\n<ul>\n<li>EEO will not share the employee&#8217;s medical records or details of an employee&#8217;s medical condition with a supervisor or the department.<\/li>\n<li>General, limited information about a medical condition&#8217;s impact may need to be shared with supervisors and certain University staff when there is a &#8220;need to know&#8221; in order to effectively conduct the interactive process and\/or implement accommodations<\/li>\n<\/ul>\n<p><strong>What is an &#8220;obvious disability&#8221;?<\/strong><\/p>\n<ul>\n<li>In certain cases, documentation of a medical condition is unnecessary because the condition&#8217;s existence is clear. <em>An <\/em><em>example<\/em> of an &#8220;obvious disability&#8221; is when an individual uses a   In such a case, medical documentation would not be required when the accommodation request is clearly related to the individual&#8217;s obvious disability.  However, EEO can always request medical documentation to better understand the nature of the disability and the need for the requested accommodation.<\/li>\n<\/ul>\n<p><strong>Who<\/strong> <strong>qualifies<\/strong> <strong>as<\/strong> <strong>a \u201chealth<\/strong> <strong>care provider&#8221;?<\/strong><\/p>\n<ul>\n<li>The appropriate health care provider will depend on the specific disability and its functional impact in each Some examples of appropriate health care providers include but are not limited to doctors, psychiatrists, psychologists, nurses, licensed mental health professionals, physical therapists, speech therapists, and vocational rehabilitation specialists.<\/li>\n<\/ul>\n<p><strong>If I want to submit a letter from my health care provider to support my accommodation request, what should the letter <\/strong><strong>say?<\/strong><\/p>\n<ul>\n<li>A letter from your health care provider should contain the following information:<\/li>\n<li>A description of your medical condition, including its nature, severity, and expected<\/li>\n<li>The activity or activities that the condition limits, and its impact on the activity; and<\/li>\n<li>What accommodation(s) are considered medically necessary because of the condition and the length of time of the accommodation?<\/li>\n<\/ul>\n<p>EEO asks only for medical documentation related to the accommodation request. hiring department)<\/em><\/strong><\/p>\n<p>The review panel or search committee members are responsible for evaluating <strong><em>ALL<\/em><\/strong> applicants released by HR to determine if minimum qualifications are met by each applicant as outlined in the posted job description. <strong>All <\/strong>applicants must be listed, evaluated, and scored on a standardized evaluation matrix or scoring tool.<\/p>\n<p>Applicants must meet both prongs of required minimum qualifications, including both <em>required education<\/em> and <em>years of work experience,<\/em> to be considered for further evaluation.<\/p>\n<p>The best way to begin evaluating is to compare each applicants\u2019 resume\/CV with the minimum qualifications for the position.\u00a0 Hiring departments should develop a interviewing process should not be conducted until the posted position has closed, and evaluations have been completed for <strong><em>all<\/em><\/strong> applications released to the hiring department so that all qualified applicants can receive full consideration. A justification should be identifiable on the evaluation matrices\/scoring tools for moving selected applicants to the next stage of interviews. There should be one final completed copy of the evaluation matrix with all evaluation scores captured for all applications received.<\/p>\n<p>If a position is posted \u2018<em>Open until Filled,\u2019<\/em> managers are required to continuously review and evaluate `all applications released by HR periodically up to the point that they are ready to extend an offer.\u00a0 At that point, HR should be contacted so that the posting can be closed.<\/p>\n<p>A standard set of job requirement based interview questions should be prepared in advance of scheduling interviews. Review the Position Description when preparing the interview questions. Ask questions about the technical skills and related experience necessary to fulfill the duties of the position. Interview questions should be designed to permit a fair and objective evaluation of each applicant.<\/p>\n<p>Each applicant interviewed should be asked the same standardized questions, and all <strong><em>(job-related<\/em><\/strong>) responses should be documented in writing on a standardized interview questionnaire. It is permissible to ask candidates if they are legally eligible to work in the U.S. and whether or not they require any type of visa sponsorship.<\/li>\n<li>If a candidate requires visa sponsorship, it is important to contact HR immediately.
