Use the following steps to complete this task:<\/p>\n<ol>\n<li>Log into\u00a0<em>Accommodate <\/em>by clicking on the\u00a0<a href=\"https:\/\/protect-us.mimecast.com\/s\/3RfiCERmrnuWjLgIN6wTg?domain=pvamu-accommodate.symplicity.com\/\">https:\/\/pvamu-accommodate.symplicity.com\/<\/a>.<\/li>\n<li>Click on <strong>Accommodation<\/strong>\u00a0tab in the left sidebar and then select\u00a0<strong>Semester Request<\/strong>\u00a0from the submenu.<\/li>\n<li>Click on <strong>Add New<\/strong><\/li>\n<li>From the\u00a0<strong>Semester\u00a0<\/strong>dropdown menu, select the semester for which you are renewing your accommodations.\u00a0 The page will reload, and you will see your course schedule on the right side of the screen.\u00a0\u00a0<em>If your course schedule does not appear<\/em>, please still complete your semester request.<\/li>\n<li>Select\u00a0<strong>Submit for All Accommodations <\/strong>or\u00a0<strong>Review the Renewal<\/strong>.<\/li>\n<\/ol>\n<p><strong>Note: <\/strong><\/p>\n<p>If you select\u00a0<strong>Submit for All Accommodations<\/strong>, you are requesting that all approved accommodations are applied to your next semester classes.<\/p>\n<p>If you select <strong>Review the Renewal<\/strong>, you have the opportunity to review your approved accommodations and delete them as necessary. If you know a particular accommodation is no longer effective, you can opt to delete it for that semester.\u00a0\u00a0<strong>Complete this process for each accommodation listed<\/strong>.<\/p>\n<p>If you add or drop any courses after you complete a semester request for the same semester, please notify ODS immediately.<\/p>\n<ol>\n<li style=\"list-style-type: none;\">\n<ol>\n<li provide reasonable accommodation to qualified individuals with disabilities who are employees or applicants for employment, except when such accommodation would cause an undue hardship.<\/p>\n<p>&nbsp;<\/p>\n<p>This section examines what &#8220;reasonable accommodation&#8221; means and who is entitled to receive it. The Guidance addresses what constitutes a request for reasonable accommodation the final section of this Guidance discusses undue hardship.<\/p>\n<p><strong><span style=\"text-decoration: underline;\">Reasonable Accommodation<\/span><\/strong><\/p>\n<p>Title I of the Americans with Disabilities Act of 1990 (the &#8220;ADA&#8221;) requires an employer to provide reasonable accommodation to qualified individuals with disabilities who are employees or applicants for employment, unless to do so would cause undue hardship. &#8220;In general, an accommodation is any change in the work environment or in the way things are customarily done that enables an individual with a disability to enjoy equal employment opportunities.<\/p>\n<p>The duty to provide reasonable accommodation is a fundamental statutory requirement because of the nature of discrimination faced by individuals with disabilities. Although many individuals with disabilities can apply for and perform jobs without any reasonable accommodations, there are workplace barriers that keep others from performing jobs which they could do with some form of accommodation. These barriers may be physical obstacles (such as inaccessible facilities or equipment), or they may be procedures or rules (such as rules concerning when work is performed, when breaks are taken, or how essential or marginal functions are performed). Reasonable accommodation removes workplace barriers for individuals with disabilities.<\/p>\n<p>Reasonable accommodation is available to qualified applicants and employees with disabilities. Reasonable accommodations must be provided to qualified employees regardless of whether they work part- time or full-time, or are considered &#8220;probationary.&#8221; Generally, the individual with a disability must inform the employer that an accommodation is needed.<\/p>\n<p>There are several modifications or adjustments that are not considered forms of reasonable accommodation. An employer does not have to eliminate an essential function, i.e., a fundamental duty of the position. This is because a person with a disability who is unable to perform the essential functions, with or without reasonable accommodation, is not a &#8220;qualified&#8221; individual with a disability within the meaning of the ADA. Nor is an employer required to lower production standards &#8212; whether qualitative or quantitative &#8212; that are applied uniformly to employees with and without disabilities. However, an employer may have to provide reasonable accommodation to enable an employee with a disability to meet the production standard.<\/p>\n<p>An employer does not have to provide as reasonable accommodations personal use items needed in accomplishing daily activities both on and off the job. Thus, an employer is not required to provide an employee with a prosthetic limb, a wheelchair, eyeglasses, hearing aids, or similar devices if they are also needed off the job. Furthermore, an employer is not required to provide personal use amenities, such as a hot pot or refrigerator, if those items are not provided to employees without disabilities. However, items that might otherwise be considered personal may be required as reasonable accommodations where they are specifically designed or required to meet job-related rather than personal needs.<\/p>\n<ol>\n<li>What must an employer do after receiving a request for reasonable accommodation?<\/li>\n<\/ol>\n<p>The employer and the individual with a disability should engage in an informal process to clarify what the individual needs and identify the appropriate reasonable accommodation. The employer may ask the individual relevant questions that will enable it to make an informed decision about the request. This includes asking what type of reasonable accommodation is needed. Please refer the individual to the PVAMU Office of Disability Services to complete University procedures for registering persons with a disability.<\/p>\n<ol start=\"2\">\n<li>Is an employer required to provide the reasonable accommodation that the individual wants?<\/li>\n<\/ol>\n<p>The employer may choose among reasonable accommodations as long as the chosen accommodation is effective. Thus, as part of the interactive process, the employer may offer alternative suggestions for reasonable accommodations and discuss their effectiveness in removing the workplace barrier that is impeding the individual with a disability.<\/p>\n<p>If there are two possible reasonable accommodations, and one costs more or is more burdensome than the other, the employer may choose the less expensive or burdensome accommodation as long as it is effective.<\/p>\n<p><strong><span style=\"text-decoration: underline;\">Undue Hardship<\/span><\/strong><\/p>\n<p>The only statutory limitation on an employer&#8217;s obligation to provide &#8220;reasonable accommodation&#8221; is that no such change or modification is required if it would cause &#8220;undue hardship&#8221; to the employer. &#8220;Undue hardship&#8221; means significant difficulty or expense and focuses on the resources and circumstances of the particular employer in relationship to the cost or difficulty of providing a specific accommodation. Undue hardship refers not only to financial difficulty, but to reasonable accommodations that are unduly extensive, substantial, or disruptive, or those that would fundamentally alter the nature or operation of the business. An employer must assess on a case-by-case basis whether a particular reasonable accommodation would cause undue hardship. Lesley University previously required all students living on campus to participate in, and pay for, its meal service plan &#8211; even if some students with severe allergies could not eat the food available through the plan without risk of illness. Under the Agreement, Lesley has made modifications to its meal plan to allow students with food allergies to take advantage of its food services. The Agreement also requires Lesley to consider exempting from its mandatory plan students who cannot, because of disability, take full advantage of the University&#8217;s meal service plan.<\/p>\n<p>Among other things, Lesley University agreed to:<\/p>\n<ul>\n<li>Provide gluten-free and allergen-free food options in its dining hall food lines in addition to its standard meal options;<\/li>\n<li>Allow students with known allergies to pre-order allergen-free meals;<\/li>\n<li>Display notices concerning food allergies and identify foods containing specific allergens;<\/li>\n<li>Train food service and university staff about food allergy-related issues;<\/li>\n<li>Provide a dedicated space in its main dining hall to store and prepare gluten-free and allergen-free foods; and<\/li>\n<li>Work to retain vendors that accept students&#8217; prepaid meal cards that also offer food without allergens.<\/li>\n<\/ul>\n<p>Many aspects of the Agreement will serve as a model for other schools &#8211; particularly those that require students to participate in a meal plan. However, food service plans, like Universities, are not one-size-fits-all and each school should evaluate its food service plan to assess whether reasonable modifications for its students with disabilities are necessary to avoid discrimination.<\/p>\n<ol>\n<li><strong> Is a food allergy considered a disability under the ADA?<\/strong><\/li>\n<\/ol>\n<p><strong>A:<\/strong> It depends. A disability as defined by the ADA is a mental or physical impairment that substantially limits a major life activity, such as eating. Major life activities also include major bodily functions, such as the functions of the gastrointestinal system. Some individuals with food allergies have a disability as defined by the ADA &#8211; particularly those with more significant or severe responses to certain foods. This would include individuals with celiac disease and others who have autoimmune responses to certain foods, the symptoms of which may include difficulty swallowing and breathing, asthma, or anaphylactic shock.<\/p>\n<ol start=\"2\">\n<li><strong> What is Celiac disease?<\/strong><\/li>\n<\/ol>\n<p><strong>A:<\/strong> Celiac disease is a digestive condition triggered by consumption of the protein gluten, which is primarily found in bread, pasta, cookies, pizza crust and many other foods containing wheat, barley or rye. People with celiac disease who eat foods containing gluten experience an immune reaction in their small intestines and an inability to absorb certain nutrients, leading to vitamin deficiencies that deny vital nourishment to the brain, nervous system, bones, liver, and other organs. Celiac disease affects about 1 in 133 Americans.<\/p>\n<ol start=\"4\">\n<li><strong> Does the ADA require that all public accommodations that serve food, like restaurants, also serve gluten-free or allergen-free food? <\/strong><\/li>\n<\/ol>\n<p><strong>A:<\/strong> No. The ADA does not require that every place of public accommodation that serves food to the public provide gluten-free or allergen-free food. The Lesley Agreement involved a mandatory meal program for a defined group of students living on campus.<\/p>\n<ol start=\"5\">\n<li><strong> What might a restaurant or other similar place of public accommodation need to do to accommodate an individual with celiac disease or other food allergies?<\/strong><\/li>\n<\/ol>\n<p><strong>A:<\/strong> A restaurant may have to take some reasonable steps to accommodate individuals with disabilities where it does not result in a fundamental alteration of that restaurant&#8217;s operations. The law applies to all secondary and postsecondary schools that receive federal financial assistance.<\/p>\n<p>The pamphlet lists actions schools and others who work with young people can take to meet the needs&#8211;and rights&#8211;of pregnant and parenting students.
